Session 2: Preparing for Legal Action in ASB Cases (3 hours)
Summary:
From 1st May, all new PRS tenancies in England are Assured Periodic Tenancies, and landlords can no longer rely on Section 21.
Requiring landlords to prove the ground in Court, it makes it increasingly important that ASB cases are prepared and presented in the best possible way, to maximise the chance of securing a possession order without avoidable delays.
Developed by Janine Green, a leading practitioner in ASB and Housing Member of the 1st Tier Property Tribunal (Scotland), this course uses real-life examples to explore how landlords can:
· Serve legally compliant, effective notices relying on the ASB ground
· Prepare strong cases that convince the Court that the ground is met and that it is reasonable to make a possession order
· Where using Solicitors to present their case, ensure that the work involved from them is minimal and the cost of instructing reduced.
· Reduce the likelihood of unnecessary (and costly) adjournments and delays.
This is a hands-on, interactive session designed to give landlords the confidence and knowledge to be able to prepare high quality legal cases.
Learning Objectives:
By the end of the session learners will:
- Understand the ASB ground for possession and how it applies to real life cases
- Recognise when the threshold for legal action is met
- Be able to confidently complete a proportionality assessment as a tool for proving that making the order is reasonable
- Prepare a legally compliant notice of seeking possession which relies on the ASB ground
- Recognise and understand a civil procedure rule complaint witness statement that sets out the actions by the landlord, allowing the learner to either draft the document themselves or identify the information that their legal representative will require.
- Recognise the types of evidence that are relevant and how to gather and present these
