Session 1: Managing Anti Social Behaviour (ASB) in the PRS (3 hours)

Summary:

From 1st May, all new PRS tenancies in England are Assured Periodic Tenancies, and landlords can no longer rely on Section 21.

Requiring landlords to prove the ground in Court, it makes it increasingly important that ASB is managed effectively to ensure harm caused to the neighbours and wider community is not prolonged by avoidable delays.

Developed by Janine Green, a leading practitioner in ASB and Housing Member of the 1st Tier Property Tribunal (Scotland), this course uses real-life examples to explore how landlords can:

·         Prevent ASB from happening in the 1st place

·         Respond to reports of ASB quickly to prevent escalation and nip problems in the bud

·         Ensure that where legal action in unavoidable, they have a strong case for gaining possession.

·         Seek support from other agencies where needed.

This is a hands-on, interactive session designed to give landlords the confidence and knowledge to manage ASB reports effectively.

Learning objectives: 

By the end of the session, learners will

  • Understand the legal definition of ASB and how this applies in practice.
  • Assess reports of ASB to determine whether they meet the legal definition
  • Learn practical steps that they can take to prevent ASB from occurring in the first place.
  • Understand the range of recording methods available and the types of information required.
  • Gain clarity on the most effective record keeping
  • Have a toolkit of options available for responding to ASB reports before legal action, ensuring that if formal action is required the Court is satisfied that all other steps have been taken.
  • Know where to seek wider support where the problem becomes too great for a landlord to manage alone.

This course provides learners with a toolkit of templates, including example incident recording forms and letters.
