Right to Rent changes - Further updates

Right to Rent Scheme COVID-19 Adjusted Checks Update: This information replaces the update sent on 22 September 

 

Further to our communication of 23 February 2022, we are writing to remind you that the adjustments to right to rent checks, introduced on 30 March 2020 will end on 30 September 2022. 

Landlords who continue to carry out right to rent checks remotely will be able to use Identification Document Validation Technology (IDVT) for checks on British and Irish citizens who hold a valid passport (or Irish passport card).

For clarity from 1 October 2022, landlords must carry out one of the prescribed checks as set out in the Landlord's guide to right to rent checks before the tenancy agreement commences:

1. a manual right to rent check; 
2. a right to rent check using IDVT via the services of an identity service provider (IDSP); or 
3. a Home Office online right to rent check. 

Checks using the Home Office online checking service do not require you to check physical documents and can be carried out by video call, as right to rent information is provided in real time direct from Home Office systems. 

There is no requirement to carry out retrospective checks on those who had a COVID-19 adjusted check between 30 March 2020 and 30 September 2022.  You will maintain a defence against a civil penalty, if the check you have undertaken between 30 March 2020 and 30 September 2022 was done in the prescribed standard manner or as set out in the COVID-19 adjusted checks guidance. 

It remains an offence to knowingly rent to a person who does not have the right to rent in England.
